PRIVACY POLICY

§ 1 Scope
These Terms and Conditions (hereafter: Conditions) are the contractual basis for the use of this application between Greta & Starks Apps GmbH, Richard-Ermisch-Straße 13, D-10247 Berlin, and you as our customer.

§ 2 Subject matter of the contract
With "Greta" we offer you an application, in parallel with a paid film (in cinemas or open air), (purchased or rented) on TV or DVD on a mobile device, to hear an appropriately synchronized audio description or audio version and to read synchronized subtitles.

§ 3 Warranty
(1) We are liable for material defects or defects in the application according to the applicable statutory provisions, in particular §§ 434 ff. BGB. The statutory limitation period for warranty claims is two years. 
(2) We are liable to you in all cases of contractual and non-contractual liability for gross negligence in accordance with statutory provisions for damages.
(3) In other cases, we are only liable for breach of a contractual obligation where fulfillment is essential to the proper execution of the contract, and on whose compliance you as a customer may properly expect to see fulfilled. (so-called cardinal duty), namely limited to the compensation of foreseeable and typical damage. In all other cases, our liability is excluded
(4) Our liability for loss or damage arising from death, personal injury, damage to health in accordance with provisions set out in the Product Liability Act remain unaffected by the above terms.

§ 4 Copyright
We have copyrights or are licensees for all images, illustrations, text, programs etc. For the use these applications, along with downloading the application and the barrier-free versions (audio descriptions and subtitles) as well as the multilingual versions, we grant you simple utilization rights on a mobile device for a non-commercial, private reproduction of the audio descriptions and subtitles in a cinema screening (or using DVD, TV, VoD). We dissociate ourselves from the use of this film industry service in connection with illegally downloaded or streamed movies. No other rights are granted.

§ 5 Data protection declaration
At Greta & Starks we take the protection of your personal data very seriously and want to explain to you in this data protection declaration what data we collect and what measures we take to protect your privacy. We ask you to register in order to offer you a better movie selection. We assure you that we keep your personal data confidential and handle it in accordance with GDPR - EU General Data Protection and the federal data protection laws of Germany, as well as this data protection declaration.

What information do you make available to us?
Your login information: To use Greta you must register first. You provide us with information such as your name, surname, email, country and password. 

Customer support: By giving us information about how you use our services we are able to offer you customer support. For example, you could send us an email concerning problems with using our app.

What information is collected automatically?
Usage information: We collect service specific information, performance information, as well as information for diagnostic purposes. This includes information about your activity (e.g. what audio description and subtitles you download and play), login data, as well as reports about diagnostics, crashes, websites and performance.

Cookies: To improve your use experience with Greta we use the analysis services of Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. This analytical tool functions on the basis of cookies. Information stored by the cookies are generally transferred to a server at Google in the USA.

How do we use your data?
Providing attractive movies via our app requires high security standards. We have implemented the registration process as well as other data protection measures to protect the customer’s sensitive data such as the audio description and subtitles. We are conscious of our responsibilities in handling your data and will never transfer it to unauthorised third parties. For each individual barrier-free version we create a usage analysis on behalf of the customer. This analysis shows how often Greta overall played audio descriptions and subtitles of a movie. For this purpose, we only use anonymised data which we provide only to our authorised contractors. In case we commission a third party to process data on the so-called “data processing contract“, this is done according to the Article 28 of the GDPR - EU General Data Protection.

How do we protect your data?
Firstly, we would like to stress that the only purpose of this registration is to offer you a more attractive selection. We only need your address. We don’t need any other personal data such as IP address or payment information such as bank or credit card information.

Your personal information is protected by technical and organizational security measures to minimize risks associated with their loss, misuse, unauthorized access, unauthorized disclosure and alteration. For example, we use firewalls and data encryption, as well as physical access restrictions on our data access authorization controls.
 

Information, correction and deletion
Each user has the right to receive free information from Greta & Starks about the personal data about him that has been stored. For information, a request for information must be made, and the requestor must provide the following information for his identification: e-mail address, first name, surname, date of birth and postal address. The information will be sent by email to the address provided by the user.

A correction of the personal data is possible at any time following a written submission of the request for information. The requestor must provide the following information for his identification: email address, first name, name, date of birth. Regardless, the user of Greta & Starks has the right at any time to request the correction of inaccurate data,

If the user requests the deletion of his personal data, this can be done by e-mail or letter stating the following identification features: Email address, first name, name, date of birth and postal address. The confirmation will be sent by email or post to the address provided by the user.

Please note that deleted data can still be retrieved due to caching systems, search engines, the interposition of proxy servers and the like, without them still existing in our systems.
